Transport and general regulations valid for the Pila ski area and for the skiing facilities run by “Pila S.p.A.”

Do not ski in our ski area without first having completely read the transport and general regulations.

OPERATIONAL PERIOD

The opening and closing of the winter and summer operational periods is unquestionable and decided by management depending on climatic conditions, the state of the ski runs, the amount of snow and the skiing facilties maintenance technical requirements. When this decision depends on binding exigencies or circumstances beyond the management’s control, the skiing facilities can be partially or totally closed down temporarily or permanently.

OPENING AND CLOSING TIMES

The opening and closing times are decided by management and made public by notices put up at the ticket offices and at the skiing facilities stations. These times can even change during the day depending on technical, service, or safety reasons or due to circumstances beyond the management’s control.

OPERATIONAL FACILITIES

The number and type of facilities operating on a daily basis is decided by the management and can change, even without prior notice, because of  technical, service, or safety reasons or due to circumstances beyond the management’s control. The facilities open are made public on a  daily basis by notices put up at the main ticket offices.

SKIING

You are in a mountain environment where changeable conditions, both natural and artificial, are innate skiing risks. If you have no intention of accepting these risks, please do not ski in our resort. No skier will have the right to hold the skiing resort workers responsible for accidents resulting from any innate skiing risks, that is from conditions which are a natural part of skiing, but not limited to:

  • Changeable weather conditions
  • Variations in the gradients of the slopes
  • Snow condition (icy, slushy, etc)
  • Terrain surface condition (parts with no snow, stones, branches or holes)
  • Accidents involving ski lifts or other facilities
  • Collisions involving other skiers
  • Accidents caused by the skier’s recklessness
  • Skiing down closed ski runs and/or off track in unsafe or unchecked areas.

Off-piste trails are neither signalled nor protected against the dangers of high altitude mountainous areas, where risks are hidden and absolutely unpredictable.

Off-piste trails can be dangerous at any moment during the winter season.

If you decide to venture off the marked runs, you do so under your own personal responsibility and at your sole risk and peril.

The company Pila S.p.A. accepts no responsibility or liability and will not be held responsible for any accident that may occur outside the signalled pistes.

In case of accident please keep calm, analyse the situation, call the emergency number 118, start a search by using sight and hearing, memorise the time of the event.

DOWNHILL SKI RUNS

  • Piste grooming is carried out according to the management’s unquestionable discretion.
  • A list of ski runs which are closed for safety or technical reasons and therefore cannot be used can be found on special signs. The ski runs are understood to be closed fifteen minutes after ski lifts closing time.
  • The rescue service only monitors the ski runs which are open. Daily monitoring stops after the last ski run check.
  • For the rescue service on the pistes a fee of € 200.00 will be charged to provide for partial coverage of the rescue costs.
  • It is strictly forbidden to use sledges or any means of mechanical transport, even if the ski runs are closed. The offenders will be held resposible for any damage done to the ski runs or claims resulting from the passing of the above mentioned means of transport.
  • It is forbidden to enter the slopes with equipment other than skis, mono-skis and snowboards, with the exception of mechanical equipment serving the slopes and ski facilities and it is therefore absolutely forbidden to use sledges and bobsleighs of any kind whatsoever.
  • Ski run classification according to difficulty – black, red, blue – is an indication of the difficulties that can be encountered, therefore the skier must judge for himself if he/she can use the runs without causing accidents to him/herself or to others. Every skier must respect the signs situated along the ski runs.The skier must behave in any event, in accordance with the characteristics of the slope and surrounding circumstances, so as not to cause risk to the safety of others.
  • The artificial snow-making machine could be operational and snowmobiles as well as grooming machines could be present on the ski runs at any given time. Skiers must give precedence to mechanical vehicles serving or maintaining the slopes and facilities and must allow them to move about easily and rapidly. We therefore urge you to ski carefully, look ahead and be ready to stop if necessary.

RULES OF BEHAVIOUR ON THE SKI SLOPES

General rules of behaviour that must be complied with by the users of ski pistes, with the aim – among others – of avoiding consequences under civil and criminal law.

  • Respect for others: every skier must behave in a way that does not pose risk of injury to anyone else or damage to property.
  • Mastery of speed: every skier must keep his or her speed constantly under control and behave in a way suited to his or her skill, all general conditions, and the weather.
  • Choosing direction: the skier uphill, in a dominant position for the choice of the path of descent, must maintain a direction that avoids risk of colliding with skiers downhill.
  • Route and right of way: a skier has to pay attention to other skiers’ course, even considering skiing equipment: skis, snowboard, telemark skis, carving skis. Skier must give way to operating tracks and first aid machines.
  • Overtake: a skier may overtake another skier above or below and to the right or to the left provided that he leaves enough space for the overtaken skier to make any voluntary or involuntary movement.
  • Minimum space required for passing at the edge of the ski slope: skiers are urged never to curve to the outermost edge of the ski slope and to always leave sufficient space for others to pass them.
  • Entering or crossing: skiers entering a ski slope or crossing a school field must make sure to be able to do so without posing risk to themselves or others by first looking uphill and downhill. The same precautions must also be taken before starting to ski again after pausing.
  • Stopping on the piste: when a skier needs to stop, he must avoid stopping on the piste in narrow places or where visibility is restricted.
  • Walking on the slopes: it is forbidden to walk through the slopes. If necessary, skiers must walk on the side of the piste. Slopes’ responsible can authorize skiers walk on the piste, but only on its side.
  • Respect of rules: skiers must respect all signs and marks. It is compulsory for all children under the age of 14 to wear a certified helmet (except skiers with a ski pass bought abroad).
  • In case of accident: everyone is required to provide assistance in case of accident.
  • Identification: anyone who is involved in an accident or is a witness to one is required to provide identification.
  • Violation of these rules may result in administrative sanction involving the payment of an amount of money (€ 50,00 – € 300,00).
  • Surveillance Authority is managed by police force and county police (L.R. 24/2007).
  • Further rules of behaviour are fixed by National Law (363-2003), by Regional Law (2-1992 and 27/2004) and by Regional guideline (2-1996).

We hereby ask you to accept your responsibilities and to ski carefully, keeping a check on your speed.

USING THE SKIING FACILITIES

  • The users must take the utmost care and attention, so as not to be a danger for themselves or for others, they must abide by the law and respect rules and regulations, particularly all the instructions and warnings found on notices and signboards put up in the ski stations or along the ski runs.
  • In case of adverse weather conditions (strong winds or unremitting gusts) personnel will immediately notify the public that the service cannot be kept running at regular intervals therefore the user must be aware that the amount of time needed by the ski lifts is no longer quantifiable or controllable.
  • The users have to pay for any direct or indirect damage they may cause to other people, the facilities or other things belonging to the company or third parties.
  • Regardless of any limitations or conditions provided for by applicable laws concerning the use of skiing facilities by children or minors and bearing in mind that using chair-lifts or ski-lifts presumes the user has the ability and/or is well-suited for snow sports, and that he/she is fit for physical exertion, users who even momentarily are not in the above conditions, cannot use the skiing facilities.
  • Management reserves the right to not permit use of the facilities to, other than cases priovided for by law, people who are obviously unfit because of maiming, physical or mental conditions, being drunk and disorderly, and who do not seem to be able to use the facilities without danger to themselves and to others.
  • It is strictly forbidden to bring animals onto the facilities, into public premises or skiing area. Management may however allow dogs to be brought onto certain facilities providing they are kept on a leash, wear a muzzle, and the appropriate fee is paid.
  • It is also forbidden to transport things, materials and equipment, other than what is strictly necessary for the snow sports authorized in the skiing area; moreover the company refuses any responsibility regarding damage, loss, theft, or destruction of things allowed, whether they be with the user or not.
  • It is strictly forbidden to use any type of sledges, bobsleds or any means of mechanical transport.
  • The company cannot be held responsible for any damage done to motor vehicles or things left in the car-parks if these areas are free of charge.
  • In case of accidents or injuries or when dangerous situations occur or simply as prevention, the person concerned, or if he/she is not in the condition to do so, everyone who is aware of the situation, will immediately have to report the event to the company’s personnel so that all necessary measures can be taken in the least time possible. Except for cases set out in article 593 of the Italian Criminal Code, anyone practicing skiing or other snow sport who, in the event of finding a person in difficulty, does not provide the necessary assistance, or does not immediately inform the manager of any call station of the occurrence of an accident is subject to an administrative fine of between 250 and 1,000 Euros.
  • It is forbidden to use the ski-lifts when notices informing the public that they are closed have been put up or when access to departure points is not being monitored by authorized personnel.

COMPETITIONS AND SPORTING EVENTS

  • Management reserves the right to close, as long as deemed necessary, certain ski-runs, routes, areas and public premises to the public if  these are needed for competitions or sporting events. In these cases certain skiing facilities could be assigned for use exclusively by the athletes and personnel involved, as required.
  • The company will only make available to the competition and sporting events organizers equipment and materials belonging to the company itself, without taking on any responsibility regarding those taking part or any third parties involved. The organizers will have to prearrange any measures necessary to guarantee that the competitions and events go off without incident, reducing to the smallest area and the least time necessary restrictions concerning everyday users. The organizers will take on responsibility for any company personnel that may be destined to assist them for all the time they are made available to the organizers.
  • The company will not take on any responsibility for anyone when a third party organizes services of any given type within the company’s ski area, as the company’s responsibility is strictly limited to the ski lifts.

TICKET PRICES

  • All prices refer to the first month prior to their publication and usually apply for the entire season.However they can be changed at any given moment when the cost of living and/or tax load vary significantly.
  • All special prices can only be applied on the showing of suitable papers that unequivocally prove that the user qualifies for the special reductions. The person entitled to a reduction must be present at the time of purchase. The skiing faclities operators or company inspectors also have the right to ask for the above mentioned papers.
  • Travellers must provide themselves with appropriate tickets before using the ski facilities. Any abuse will result in the pass being definitely confiscated unless the application of administrative and legal sanctions under Law.
  • The purchase of tickets solely entitles to use the relevant skiing facilities, for the indicated route(s), on the mentioned day(s) of validity and according to the number of travellers using the facilities.
  • No compensation or refund will be given in case of long queues due to any given reason, or if the service is interrupted because of technical problems or bad weather, or if the traveller does not use even part of the facilities due to events for which the company is not responsible.
  • Management, upon its unquestionable judgement, has the right to decide on the opening and closing hours and periods of the facilities and the pistes. Ski pass prices are independent of the number of ski lifts and ski pistes open during the period of validity of the ski pass. Season tickets entitle holders to use the facilities when open, regardless of the duration of the season. Publication of the duration of the season does not oblige management to open the ski station.
  • When transport takes place without payment of the amount due, it is understood that the company takes on no responsibility or commitment.
  • Any type of ticket, except single runs and vouchers with points, is strictly personal and is not transferable.
  • No type of ticket can be wholly or partially refunded or substituted if the buyer cannot use it for any reason, nor if the ticket is lost, destroyed, or damaged.
  • Customers are requested to check their ski passes the moment they collect them. They cannot be replaced, nor can the duration of a used ticket be extended.
  • Buying a ticket implies that the buyer is aware of and accepts all the conditions set out in these rules and regulations displayed to the public at the ticket offices.

PROCESSING PERSONAL DATA

  • Your personal data will be processed for the purposes of carrying out and fulfilling the transport contract entered into with us and for handling any judicial or jurisdictional claims; in such case sensitive data will also be processed. In certain cases we also process personal photographs and scan them in order to enable us to check that the ski-pass is correctly used. The storage medium mounting the ski pass contains an RFID chip and is therefore considered an RFID label pursuant to the provision of the Personal Data Protection Commissioner dated 9 March 2005. Information on the cable journeys made by you are kept only for checks to be carried out in the event of litigation, in the case of disappearance of persons and for the management of any ticket refunds in the event of injury occurring on the ski slopes; apart from these cases the information is available only to you; sensitive data is processed during rescue operations for the purpose of recording what has happened and for the resolution of any judicial or jurisdictional disputes.
  • The data may be processed with or without electronic or automatic means and will include – in accordance with the limits and conditions set out in article 11 of the CODE RELATING TO THE PROTECTION OF PERSONAL DATA – all operations or group of operations set out in article 4 (1) (a) of the Legislative decree 196/2003 and necessary for the processing in question, including therein also communication in relation to those set out below of this notice.
  • The provision of personal data relating to the process in question is obligatory in so far as it is necessary for the provision of the services requested.
  • Personal data relating to the process in question may be communicated:
    • to our internal persons in charge;
    • to insurance companies for dealing with and resolving disputes;
    • to lawyers for dealing with and resolving judicial and jurisdictional disputes.
  • All those interested in the process in question have the right set out in article 7 of the CODE RELATING TO THE PROTECTION OF PERSONAL DATA. Those concerned have the right to know that at all times they are the owners of their own personal data in our possession and to know how it is being used. They also have the right to have it updated, supplemented, rectified or cancelled, to request its suspension or oppose its processing.
  • The authority responsible for the processing concerned is Pila S.p.A. – fraz. Pila, 16 – 11020 GRESSAN (AO) – ITALY, which can be contacted by written request sent by recorded delivery letter, fax or e-mail.
